Where do we store your data?
The data that we collect from you is stored within the European Economic Area (“EEA”) but may also be transferred to and processed in a country outside of the EEA. Any such transfer of your personal data will be carried out in compliance with applicable laws.

For transfers outside the EEA, H&M will use Standard Contractual Clauses and Privacy Shield as safeguards for countries without adequacy decision from the European Commission.

Who access your data?
Your data may be shared within the H&M group (for details on the companies within the H&M group, please refer to our annual report which may be found at about.hm.com). The local H&M company will only act as  the personal data processor and processes the personal data on behalf of the Swedish company.

We never pass on, sell or swap your data for marketing purposes to third parties outside the H&M group. Data that is forwarded to third parties, is only used to provide you with our services. You will find what categories of third parties under every specific process below.

What is the legal ground for processing?
For every specific processing of personal data we collect from you we will inform you whether the provision of personal data is staturtory or required to enter a contract and whether it is an obligation to provide the personal data and possible consequenses if you choose not to.

What are your rights?
Right to access: 
You have the right to request information about the personal data we hold on you at any time. You can contact H&M that will provide you with your personal data via e-mail.

Right to portability: 
Whenever H&M process your personal data by automated means based on your consent or based on an agreement you have the right to get a copy of your data in a structured, commonly used and machine-readable format transferred to you or to another party. This only includes the personal data you have submitted to us.

Right to rectification: 
You have the right to request rectification of your personal data if they are incorrect, including the right to have incomplete personal data completed. 

If you have a H&M account or Club membership you can edit your personal data under your account and membership pages.

Right to erasure:
You have the right to erase any personal data processed by H&M at any time except for the following situations

*you have an ongoing matter with Customer Service
*you have an open order which has not yet been shipped or partially shipped
*you have an unsettled debt with H&M, regardless of the payment method
*if you are suspected or have misused our services within the last four years
*your debt has been sold to a third party within the last three years or one year for deceased customers
*your credit application has been rejected within the last three months
*if you have made any purchase, we will keep your personal data in connection to your transaction for bookkeeping rules

Your right to object to processing based on legitimate interest: 
You have the right to object to processing of your personal data that is based on H&M legitimate interest. H&M will not continue to process the personal data unless we can demonstrate a legitimate ground for the process which overrides your interest and rights or due to legal claims.

Your right to object to direct marketing:
You have the right to object to direct marketing, including profiling analysis made for direct marketing purposes.

Right to restriction:
You have the right to request that H&M restricts the process of your personal data under the following circumstances:

*if you object to a processing based H&M legitimate interest, H&M shall restrict all processing of such data pending the verification of the legitimate interest.
*if you have claim that your personal data is incorrect, H&M must restrict all processing of such data pending the verification of the accuracy of the personal data.
*if the processing is unlawful you can oppose the erasure of personal data and instead request the restriction of the use of your personal data instead

If you consider H&M to process your personal data in a incorrect way you can contact us. You also have the right to turn in a complaint to a supervisory authority.

    When you apply for credit as a method of payment we will perform an automated decision-making regarding your credit application. You have the right to to express your point of view and to contest the decision with a member of staff.

    You have the right to withdraw your consent for the processing of your personal data at any time and object to direct marketing.

    When you do so H&M won't be able to send you any further direct marketing offers or information based on your consent.

    How long do we save your data?
    We will keep your data for direct marketing until you withdraw your consent. 

    For e-mail marketing we will consider you an inactive customer if you haven't opened an e-mail for within the last year.

  • Why do we use your personal data?
    We will use your personal data to create and manage your personal account in order to give you a personalized and relevant experience at H&M. 

    We will provide you with your order history and details around your orders and enable you to handle your account settings (including marketing preferences). We will also provide you with easy ways to maintain accurate and updated information such as contact details and payment information. Further we will enable you to save items in your shopping bag, offer you size recommendations and enable you to rate and review the products you've purchased from us.

    How long do we keep your data?
    We will keep your data for 100 days for telephone and  e-mails logs and correspondence for 12 months for  case management. 

    For in store complaints your personal data will be saved for 2 years, except for the US where it is saved for 5 years.

    Your right to object to processing based on legitimate interest: 
    You have the right to object to processing of your personal data that is based on H&M legitimite interest. H&M will not continue to process the personal data unless we can demostrate a legitimate ground for the process which overrides your interest and rights or due to legal claims.

  • Why do we use our data?
    We will process your data when you enter our competitions online. Your personal data will be used  for H&M to contact contestants regarding the competition, before and after an event, to identity contestants, verify the age of contestants, to contact winners, deliver and follow up on prize deliveries.

    You have the right to withdraw your consent for the processing of your personal data at any time. When you do so H&M will not be able to provide you with the services mentioned above.

    How long do we save your data?
    We will keep your personal data for 45 days after the competition has ended.

     

  • Why do we use your personal data?
    We will use data to evaluate, develop and improve our services, products and systems for all of our customers. For this purpose we will not analyse your data on an individual level, all processing will be done on pseudonymized data.

    This includes analysis to make our services more user-friendly, such as modifying the user interface to simplify the flow of information or to highlight features that are commonly used by our customers in our digital channels and to improve IT systems in order to increase the security for our visitors and customers in general.

    The analysis is also used to develop and constantly improve the logistics flow of goods by forecasting purchases, stocks and deliveries as well as our resource capacity from a sustainability point of view by streamlining purchasing and scheduling of deliveries.

    In addition we use the data to be able to plan new establishments of stores and warehouses and improve our product range.

If your data is incorrect, incomplete or irrelevant, you can ask to have the information corrected or removed. We cannot remove your data when there is a legal storage requirement, such as book-keeping rules or when there are other legitimate grounds to keep the data, such as unsettled debts. How do we protect your personal data?
We have taken technical and organisational measures to protect your data from loss, manipulation, unauthorised access. We continually adapt our security measures in line with technological progress and developments. To make card purchases with us as secure as possible, all information is sent in encrypted form.  This means that the information is passed through a secure connection and that your personal data cannot be read by external parties. For card purchases we work with an authorised payment agent that helps us to check directly with your bank that the card is valid for purchases. Our payment agent processes your card details according to the international security standard PCI DSS, which was developed by the card companies VISA, MasterCard, Diners, American Express and JCB. This means that your card details are processed with a very high level of security. When you pay by card, we reserve the right to carry out an identity check.

Pengenalan

Siapakah yang bertanggungjawab terhadap data peribadi anda?

  • Untuk menguji dan meningkatkan sistem kami yang mana perkhidmatan disediakan
  • Untuk menghalang penyalahgunaan atau penggunaan yang tidak betul terhadap perkhidmatan kami
  • Untuk mengira mata Club yang anda layak sebagai ahli Club

  • Untuk mematuhi keperluan operasi, audit, perundangan, penguatkuasaan, cukai dan perakaunan, sama ada di dalam atau di luar tempat bidang kuasa yang anda tinggal

Jika anda memilih untuk tidak memberikan data peribadi anda kepada kami bagi tujuan di atas, anda mungkin tidak dapat menerima semua perkhidmatan yang kami tawarkan melalui laman web kami. Kami akan menyimpan data anda selama yang diperlukan untuk memenuhi tujuan di atas atau selama yang dibenarkan oleh undang-undang. Selepas ini, data peribadi anda akan dipadam.

Apakah hak anda?
Anda mempunyai hak untuk meminta maklumat mengenai data peribadi anda yang kami simpan pada bila-bila masa (percuma sekali setahun). Jika data anda tidak tepat, tidak lengkap atau tidak relevan, anda boleh memohon supaya maklumat tersebut dibetulkan atau dikeluarkan. Bagaimanakah kami melindungi data peribadi anda?
Kami telah mengambil langkah teknikal dan berorganisasi untuk melindungi data anda daripada hilang, dimanipulasi, akses tanpa kebenaran. Kuki

H&M menggunakan kuki untuk meningkatkan dan meringkaskan lawatan anda. Kami tidak menggunakan kuki untuk menyimpan maklumat peribadi, atau untuk mendedahkan maklumat kepada pihak ketiga.

Terdapat dua jenis kuki: kekal dan sementara (kuki sesi). Kuki kekal disimpan sebagai fail pada komputer atau peranti mudah alih anda selama tidak lebih daripada 12 bulan. Kuki sesi disimpan sementara dan hilang apabila anda menutup sesi pelayar anda. Kami menggunakan kuki kekal untuk menyimpan pilihan halaman mula anda dan untuk menyimpan butiran anda jika anda memilih "Ingat saya" apabila anda melog masuk. Kami menggunakan kuki sesi apabila anda menggunakan fungsi penapisan produk, untuk memeriksa sama ada anda melog masuk atau jika anda meletakkan item dalam beg pembelian anda.

Kuki yang digunakan ialah kuki jenis kekal dan sementara (kuki sesi). Kuki kekal disimpan pada komputer atau peranti mudah alih anda selama tidak lebih daripada 24 bulan.

Laman hm.com dan aplikasi H&M mungkin menyertakan pautan ke laman web lain yang tidak berada dalam seliaan kami. TERMS & CONDITIONS

1. General
The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with H & M Hennes & Mauritz GBC AB, hereinafter referred to as “H&M”, ”us ” or ”we”, at the H&M website, mobile website, or mobile application (jointly referred to as  ”hm.com”).

By using hm.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.

Only persons of legal age, 18 or 20 years, or older depending on your place of recidency, who are not under guardianship, and are not acting in capacity as a company, with a physical address in one of the countries that H&M provides deliveries to can place an order. The inclusion of any products or services on hm.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on hm.com at the time you place your order.

H&M want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the hm.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

2. Prices and delivery charges
The prices displayed at hm.com does not include a delivery charge.
The price does not include import taxes or custom duties. Import taxes/custom duties will be charged by your carrier at delivery and H&M does not compensate these charges.

If the value of your order exceeds the toll free limit in your market extra fees will be applied upon delivery. Please check with your local customs office for more information. You can also read more here.

The delivery charge for each order will be the same, regardless of the size or weight of your order. The cost for each delivery method is clearly indicated during the check-out process. For more information regarding delivery cost please visit our customer service pages for further information. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries. Prices in store and online may vary.

3. Ordering/conclusion of contract
The ordering option available to you is via hm.com. Please visit our customer service pages for further information.
Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you and ask you to contact H&M Customer Service who will settle the refund.

4. Delivery
H&M exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order in accordance with your selected delivery option.

H&M endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. We aim to deliver within 4 to 10 working days following confirmation of an order. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 30 days, you may cancel your order.

Before you place your order, you will be informed of the expected delivery details. Once you have placed your order you will receive an email confirmation with your expected delivery details.

5.  Withdrawal of Order
You may return your order from the date you place the order until [7/14/30] days after receipt of the ordered items. Please note that you will bear the cost of the return of the items to H&M, unless otherwise stated by your local customer rights legislation. You will find the full Returns Policy at hm.com here.

If you wish to return your order, please provide us with notice in writing either by post, preferably by using the pre-printed return form in your parcel, or by sending a letter to H&M Customer Service, please visit our customer service for contact information. You can also provide us with notice by filling in and submitting the standard form issued by your local Consumer Rights Authority. You will have to return the item(s) to us as set out in section 6 (Returns) below within the [7/14/30] day period set forth in section 5.1 above. We will provide a refund attempting to use the same method used to make the payment (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 14 days of receiving your notice of cancellation, provided we have received the items or evidence of you having sent back the items. Another payment method may be used for the refund, provided that you consent to such change; in any case this will not generate any additional charges.

If the item you have received is defective, please notify H&M promptly and return the item in accordance with section 6 (Returns) below. H&M will, for any products deemed defective, provide a full refund. The provisions set forth herein do not limit any applicable statutory rights.

6. Returns
H&M guarantees a full refund for any returned items in accordance with section 5 (Withdrawal of Order), provided that all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags should be intact.

All our parcels contain a pre-printed return form for you to use if you decide to return any items. You will find more detailed information regarding our return process on the delivery note and in our Returns Policy.

Where H&M operates the site in US Dollars, H&M is  not responsible for currency fluctuations that occur when  issuing refunds to a credit or debit card denominated in a currency other than US Dollars. We will not refund any bank charges.

7. Payment methods
You can pay for your goods as set out below.

Payment before delivery
Credit card or debit card

You can enter your payment details at the time you place your order using a valid credit or debit card (VISA or Mastercard). The applicable amount will immediately be reserved on your card but will not be debited until the goods are dispatched. H&M reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks. Please note that any applicable bank charges will be borne by you.

Please note that we are unable to accept gift cards and merchandise cards as forms of payments via hm.com.

You will receive the legally required invoice document in the Shipping Confirmation e-mail.

8. Our Liability
Nothing in these Terms shall exclude or limit H&M's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

H&M accepts liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

H&M is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on hm.com shall be limited to the total price of your order.

9. Colours
We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

10. Guarantee
If there are defects in the goods you have purchased, H&M abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form.

11. Assignment
H&M reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.

12. Severance
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

13. Ownership of rights
All intellectual property rights, such as trademarks and copyrights at hm.com remain with H&M Hennes & Mauritz AB and its subsidiaries or licensors. Any use of hm.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of H&M.
