FAQ

What we accept

Qualitative clothing from the current season. 


High end brands such as: Ganni, Daily Paper, Michael Kors, Tommy Hilfiger, Armani  


Premium brands such as: Massimo Dutti, All Saints, Scotch and Soda, Adidas  


And other brands such as: Zara, Monki, Mango, Asos, Topshop, ARKET, COS, & Other Stories  


We don’t accept:

Items with holes, loose seams, pills or discolored items  


Traditional or culturally appropriate clothing  


No fur or exotic skins  


No children's clothing  


And absolutely no counterfeit we don’t stand for it and will remove it.  


For us quality and style come first, please make sure you read the above list and make sure your items are washed and clean when you bring them. 


H&M Resell agreement

By accepting the below terms and conditions for H&M REsell, I, the seller, accept that H&M Hennes & Mauritz Netherlands BV will offer certain items for sale in the H&M store in Amsterdam Noord in exchange for a commission in acoordance with the terms.


General 

Seller owns the Item and has the right to freely transfer them to H&M. 


The Item is original and do not infringe upon any other party’s rights. 


Sales and commission

The Seller remains the owner of the items until sold by H&M, at which time H&M takes flash title of the Item (to allow for VAT reporting) before the ownership passes to the customer.  


H&M reserves the right to finally set the sales price. 


H&M will charge a commission on Item sold, which amounts to 60% of the sales price. 


Seller will receive 40% of the sales price of each product sold through H&M. 


Item will be available for sales in store for a period not to exceed five (5) weeks. 


If the Item is sold, Seller will get a confirmation email and the compensation will be paid out to the bank account Seller has provided. Payments of compensation will be made during the first week after the applicable month when the item was sold. Seller is responsible for reporting any income in accordance with applicable laws and regulations


If the Item is not sold, Seller will receive an email with a request to either pick up the Item in the store within seven (7) days from the time the email notification was sent, or to donate the item to H&'s textile collection. If the item has not been picked up within the seven (7) day period, the Item will automatically be donated through H&M's textile collection unless otherwise agreed via email between the Parties.  


Uncollectable items

H&M will take responsibility for the Seller’s Item during the sales period in the H&M store, however Seller acknowledges that reasonable wear and tear related to the product is expected and H&M cannot be held liable for such reasonable damage to the product. H&M assumes responsibility once the Seller has signed these terms and conditions and the product has been accepted by the store. For the avoidance of doubt, if, by the end of the applicable sales period an item cannot be found, due to lost, theft or a force majeure event in store, such as but not limited to fire, flooding, store damage etc,  then Seller will receive payment as if the product had been sold. Seller will receive the agreed compensation in accordance with the terms for payment in this agreement. 


Data Privacy

Seller’s account information will be handled in accordance with the Privacy Notice. H&M will automatically delete the Seller’s app account after the Seller has been inactive for a period of twelve (12) months. Bank account details will be deleted two (2) weeks after the payment of the last sale has been made to the Seller.

Who is responsible for the processing of personal data?

H & M Hennes & Mauritz Netherlands BV is primary responsible for the processing of personal data within the scope of In-store shopping.


Why and how do we use your personal data?

We use the personal data we obtained from you when using Resell. We use this data to register the sales. For this we need your contact and bankdata to pay your commission. 


We use your personal data in the context of Resell be able to process your purchase and payment transactions. 


Payment data collected for the purpose above will also be used, under certain conditions and limitations, business development and analytics purpose and to detect fraud and thefts in connection with sales and to comply with applicable laws. 


Who has access to your personal data?

We share your personal data within the H&M Group whenever necessary to fulfil the intended purpose. For the same reason, personal data is also shared with suppliers carrying out certain tasks on our behalf, such as order fulfillment and payment processing. H&M is always fully responsible for its suppliers. 


Except as explicitly stated herein, we never pass on, sell or swap your data to any third parties.


What is the legal ground to process your personal data?

When making products and services available to you H&M will process your personal data necessary for concluding a contract with you and to fulfil any obligations derived from that contract, whether the contract refers to a purchase transaction, or the use of other services provided by us or by third parties.


The processing of your personal data for camera monitoring purposes is based on our legitimate interest as a business.


How long do we keep your personal data?

We will keep and process your personal data no more than necessary for us to perform our contractual obligations, with at the least until the Resell agreement is ended. We only use your bankdata until we know that you received your commission, after which it will be deleted immediately.
